These Terms and Conditions apply to families seeking support services for children under the NDIS and to the support workers providing those services.
1. Acceptance of Terms
By accessing or using Young Heroes and its associated services, you agree to these Terms and Conditions. We reserve the right to update or modify these terms at any time, with or without notice, and any changes will be effective upon posting to this page. Your continued use of the website after changes are posted constitutes your acceptance of the updated terms.
2. Service Description
Young Heroes operates a platform that connects families seeking support services for children under 20 years old with qualified support workers offering services under the National Disability Insurance Scheme (NDIS). The platform allows families to search for, communicate with, and hire support workers for a variety of services, including personal care, therapy, and other support services.
3. User Eligibility
- Families: To use our platform as a family (client), you must be the legal guardian of a child under the age of 20 and have an NDIS plan or be eligible for NDIS-funded services or be willing to self fund.
- Support Workers: To use our platform as a support worker, you must hold the necessary qualifications, clearances (such as a Working with Children Check), and be compliant with all relevant laws and regulations.
By using our platform, you confirm that you meet these eligibility requirements.
4. User Accounts
To use certain features of the platform, you may be required to create a user account. You agree to provide accurate, complete, and up-to-date information during the registration process and to keep your account details secure. You are solely responsible for all activities under your account.
You must immediately notify us of any unauthorised use of your account or any security breach.
5. Responsibilities of Families
As a family using our platform, you agree to:
- You will provide accurate details about your child’s care needs, NDIS plan, and any other relevant information to ensure appropriate matches with support workers.
- Ensuring that the support worker follows the agreed-upon care plan.
- You agree to pay for services rendered by support workers through our platform in accordance with the agreed-upon rates and in accordance with our Payment Policy.
6. Responsibilities of Support Workers
As a support worker using our platform, you agree to:
- You will provide accurate and up-to-date information about your qualifications, NDIS registration, background checks, and any other necessary certifications.
- You will provide services in a professional manner, adhering to any applicable legal and regulatory standards, including those required by the NDIS, and maintain the privacy and confidentiality of families and children.
- You agree to follow all relevant NDIS code of conduct, including treating children with respect, maintaining appropriate boundaries, and reporting any concerns related to child safety.
- You will provide care according to the agreed-upon care plan and communicate any changes or issues promptly to the family.
7. Fees and Payments
Young Heroes generates invoices once a week on behalf of the support worker for the services provided. These invoices are then sent directly to the family or to their plan manager, depending on how the family is funded. The platform charges a flat 15% fee on the total amount of each invoice. After deducting the fee, the remaining balance will be paid directly to the support worker. By using our platform, you agree to the invoicing and payment structure outlined above.
Failure to make timely payments may result in suspension of services in accordance to our Payment Policy.
8. Privacy and Data Protection
We respect your privacy and are committed to protecting your personal information. By using our platform, you agree to our Privacy Policy, which outlines how we collect, use, and protect your data. We will only collect personal information necessary for providing our services and will comply with all relevant privacy laws.

9. Termination of Services
We may suspend or terminate your access to the platform if:
- You violate these Terms and Conditions.
- You engage in illegal activities, including child abuse, fraud, or any activities that threaten the safety of children.
- You fail to provide accurate information, including NDIS registration or working with children checks.
- Non Payment of services provided by our support workers.
Both families and support workers may terminate their accounts at any time. Termination of services does not relieve the parties from any payment obligations or outstanding fees incurred prior to the termination.
10. Dispute Resolution
If a dispute arises between a family and a support worker, we encourage both parties to resolve the issue directly through communication. If an issue cannot be resolved, either party may contact us for assistance, and we will attempt to mediate or assist in the dispute resolution process.
If we are unable to mediate a resolution, we may refer the matter to relevant authorities, including the NDIS Quality and Safeguards Commission or local child protection services, if applicable.
11. Limitation of Liability and Insurances
To the fullest extent permitted by law, Young Heroes is not liable for any loss, damage, or injury arising from the use of our platform, including but not limited to:
- We are not responsible for the actions or omissions of support workers in delivering services.
- We are not liable for any injury or harm that occurs during the provision of services.
- We are not responsible for any loss or corruption of data.
- We are not liable to any damage to personal property or car accidents during services.
Support workers are required to maintain appropriate insurance coverage while providing services. This includes, but is not limited to, car insurance, public liability insurance, and personal indemnity insurance.
Young Heroes is not liable for any damages or losses incurred during the provision of services by the support worker. It is the responsibility of the support worker to ensure they are adequately insured for the services they provide.
12. Indemnification
You agree to indemnify and hold harmless Young Heroes, its officers, employees, agents, and contractors from any claims, liabilities, damages, costs, and expenses arising from your use of our platform, including:
- Breaches of these Terms and Conditions.
- Violations of applicable laws.
- Any disputes or claims arising from the services provided by you or other users.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any disputes will be resolved in the courts of your state.
