By accessing and using the Young Heroes website and platform (the “Platform”), you agree to comply with and be bound by the following Terms of Use. If you do not agree with these terms, please do not use our services.
1. Introduction
Young Heroes provides a platform to connect support workers with families who require assistance. The following terms outline your responsibilities when using our website, services, and any other features provided through our platform.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a contract to use the services of Young Heroes. If you are using our services on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms of Use.
3. Services Provided
Young Heroes connects support workers with families seeking care services. Our platform allows support workers to create profiles, offer services, and be paid for their work. Families can post job listings and book services from support workers.
Services provided by Young Heroes include:
- Support workers providing personal care, home assistance, and community support.
- Allied health therapies such as physiotherapy, occupational therapy, speech therapy, and other specialised health services.
- Nursing services to meet health and medical needs of families and individuals.
The services provided are subject to the terms agreed upon between the support worker and the family.
4. User Accounts
To access the full features of the Platform, you must create a user account. By registering, you agree to provide accurate and complete information and to maintain the confidentiality of your account credentials. You are responsible for all activities under your account and agree to immediately notify Young Heroes of any unauthorised use of your account.
5. Support Worker Responsibilities
Support workers are responsible for providing professional, high-quality services to families according to the agreed-upon service terms. Support workers are required to maintain appropriate professional qualifications, including but not limited to insurance, certifications, and other legal requirements as applicable.
6. Family Responsibilities
Families using the platform are responsible for paying support workers for services rendered and adhering to all service agreements, including cancellation and payment policies. Families must communicate openly with support workers and handle all interactions respectfully.
7. Service Agreements and Payment
Support workers and families must agree on the terms of service before any work begins. Young Heroes provides invoicing services and takes a 15% platform fee from the total invoice amount. Payments should be made within the timeframe outlined in the Payment Policy.
8. Prohibited Activities
You agree not to:
- Solicit or take families or support workers off the Platform to avoid using the services provided by Young Heroes. All communications, transactions, and engagements should take place through the platform. Non Solicitation Policy
- Use the Platform for any illegal or unauthorised purpose.
- Violate any laws, rules, or regulations in connection with your use of the services.
- Engage in fraudulent or abusive behavior, including any actions that mislead or defraud other users.
- Post, transmit, or distribute any content that is offensive, defamatory, obscene, or otherwise harmful.
9. Confidentiality and Privacy
Young Heroes values the privacy of our users. We will protect your personal information in accordance with our Privacy Policy, which outlines how we collect, use, and safeguard your data. You are responsible for maintaining the confidentiality of any sensitive information you share via the platform.
10. Cancellation and Refunds
Families and support workers must adhere to the cancellation and refund policies provided in the Cancellation Policy. Cancellations made within the specified time frame may not incur any charges. In case of disputes regarding payments or services, Young Heroes encourages families and support workers to resolve the issue directly or contact us for assistance.
11. Termination of Service
Young Heroes reserves the right to suspend or terminate your access to the Platform if we suspect any violation of these Terms of Use or other related policies. We may terminate your account at our discretion, for any reason or without reason, including non-payment, abusive behavior, or any activity that violates our guidelines.
12. Limitation of Liability
To the fullest extent permitted by law, Young Heroes shall not be liable for any damages, losses, or injuries arising from the use of the Platform. This includes, but is not limited to, any claims resulting from the actions of support workers, families, or third-party services. Users agree to indemnify and hold harmless Young Heroes, its officers, employees, and agents from any claims or damages related to their use of the Platform.
13. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the issue through informal negotiation. If the issue cannot be resolved through negotiation, you agree to submit to binding arbitration under the rules of the relevant jurisdiction.
14. Changes to Terms
Young Heroes reserves the right to update or modify these Terms of Use at any time. Any changes will be posted on this page with the effective date. By continuing to use the Platform after such changes, you agree to be bound by the updated Terms of Use.
15. Governing Law
These Terms of Use will be governed by and construed in accordance with the laws of [Your State], without regard to its conflict of law principles.
16. Photo Guidelines
Appropriate photos only, support workers must upload photos that reflect professionalism and respect for the platform’s purpose. All photos must be clear, appropriate, and relevant to your profile. Support workers are prohibited from uploading shirtless photos or any image that may be considered inappropriate for a professional setting. Bikini photos or any revealing swimwear images are not permitted. Please ensure your photo represents a respectful and professional image.
17. Professionalism in Private Messages
Support workers are expected to communicate with families and other users in a courteous, kind, and professional manner at all times. Any communication should be respectful and free of offensive language, insults, or inappropriate remarks. Threatening or abusive language is strictly prohibited.
